By checking the acceptance box during enrollment, you agree to the terms of this Liability Waiver. If you are enrolling on behalf of a minor, you confirm that you are the parent or legal guardian of that minor and that you accept this waiver on their behalf.

1. Nature of Services

Educa Tutoring Inc. provides in-person, small-group academic tutoring sessions at physical centres in the Montreal area (currently: 9520 Boulevard de l'Acadie, Suite 225, Montréal, Québec, H4N 1L8, and any additional locations). Sessions take place on Educa's premises under the supervision of qualified tutors. This waiver applies to all in-person participation at our centres.

2. Who Must Accept This Waiver

This waiver must be accepted by a parent or legal guardian for any participant under 18 years of age. By checking the acceptance box, the parent or guardian represents that:

  • They are the parent or legal guardian of the enrolled student
  • They have the legal authority to accept this waiver on behalf of the minor
  • They have read and understood the full contents of this waiver
  • They accept these terms on their own behalf and on behalf of the minor participant

3. Acknowledgement of Risks

The parent/guardian (or adult participant) acknowledges that participation in in-person tutoring sessions involves being present at a shared physical premises and that, as with any in-person environment, certain inherent risks exist, including but not limited to:

  • Minor slips, falls, or physical accidents within the centre premises
  • Exposure to illness in a shared group environment
  • Personal belongings brought to the centre

The parent/guardian acknowledges that Educa Tutoring Inc. takes reasonable steps to maintain a safe environment, but cannot eliminate all risk inherent to in-person activities.

4. Release of Liability

To the maximum extent permitted by the Civil Code of Quebec and applicable consumer protection legislation, by accepting this waiver the parent/guardian (or adult participant) releases, waives, and discharges Educa Tutoring Inc., its directors, officers, employees, tutors, contractors, and agents (collectively "Educa") from any and all claims, damages, losses, or liabilities arising from or related to:

  • Participation in tutoring sessions at Educa's physical centres
  • Interaction with tutors and other students in a group environment
  • Minor accidents, incidents, or injuries occurring on the premises that are not caused by Educa's gross negligence or intentional wrongdoing
  • Cancellation or rescheduling of sessions due to tutor unavailability, facility closure, or force majeure
  • Academic outcomes, learning results, or student progress, which depend on the student's individual effort, attendance, and engagement

IMPORTANT LIMITATION: This waiver does not and cannot release Educa from liability for gross negligence, intentional misconduct, breach of the Consumer Protection Act, or any other liability that cannot lawfully be excluded under the Civil Code of Quebec or applicable Quebec consumer law.

5. Parental Responsibility

The parent/guardian agrees to:

  • Ensure that the student arrives on time and is picked up promptly at the end of each session
  • Notify Educa in advance of any medical conditions, allergies, or special needs that may affect the student's participation
  • Ensure the student is aware of and adheres to Educa's Code of Conduct
  • Contact Educa at info@educatutoring.com in the event of an emergency or urgent concern

6. Emergency Medical Authorization

In the event of a medical emergency involving a minor participant, and if the parent or guardian cannot be reached immediately, the parent/guardian authorizes Educa Tutoring Inc. staff to call emergency medical services (911) and take reasonable steps to assist the participant until emergency services arrive. This authorization does not make Educa responsible for any resulting medical costs.

7. Media Consent — Separate

This waiver does not constitute consent to the capture, use, or publication of photographs or video recordings. Media consent is addressed separately via the Media Consent Form, which must be accepted independently during the enrollment process.

8. Severability

If any provision of this waiver is found to be unenforceable under Quebec law, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.

9. Governing Law

This waiver is governed by the laws of the Province of Quebec, including the Civil Code of Quebec and the Consumer Protection Act. Any dispute arising from this waiver shall be subject to the exclusive jurisdiction of the courts of the Province of Quebec, with venue in Montreal.

10. Acceptance

By checking the "I accept" box during the enrollment process on www.educatutoring.com, you confirm that: (1) you have read and understood this Liability Waiver in full; (2) you are 18 years of age or older; (3) if enrolling a minor, you are the parent or legal guardian of that minor; and (4) you agree to be legally bound by its terms.

Your name, the date and time of acceptance, and your IP address are recorded at the time of checkbox acceptance as evidence of your agreement.
